By accessing or purchasing from www.penguin3dhouse.com ("the Site"), operated by Penguin 3D House ("we", "us"), you agree to these Terms & Conditions. Please read them carefully.
1. Products and the nature of 3D printing
Our products are 3D printed layer by layer. Fine layer lines, subtle surface texture and minor colour variation between production batches are inherent to the process and do not constitute a defect. Product images are representative; the finished item may differ very slightly in finish or shade.
2. Custom orders
- Custom and personalised items are designed from your inputs and printed only after you approve the design preview and quotation.
- Once printing has begun, a custom order cannot be cancelled or modified.
- You confirm you have the rights to any photos, logos, artwork or files you share with us, and you grant us permission to use them solely to fulfil your order.
- We may decline a custom order that is technically unprintable or violates our content policy (see section 8).
3. Pricing and payment
- All prices are in Indian Rupees (₹) and inclusive of applicable taxes unless stated otherwise.
- We accept online payments via our payment gateway (UPI, cards, net-banking) and Cash on Delivery where available.
- We reserve the right to correct pricing errors; if an error affects your order, we will contact you before proceeding.
4. Shipping and delivery
- We ship across India. Standard products dispatch in 1–3 working days; custom products require additional design and print time, confirmed at order time.
- Estimated delivery timelines are indicative. Delays by courier partners or due to circumstances beyond our control do not entitle cancellation of custom orders already in production.
- Please provide a complete, accurate address and an reachable phone number. Re-delivery charges for failed deliveries due to incorrect details may apply.
5. Returns, refunds and cancellations
Returns, replacements, refunds and cancellations are governed by our Return & Refund Policy, which forms part of these terms.
6. Intellectual property
All content on the Site — including product designs, images, text and the Penguin 3D House logo — is our property or used with permission, and may not be copied or reproduced without consent. 3D models we create for your custom order remain our design property unless otherwise agreed in writing; you receive the printed product, not the source files, unless a file purchase is agreed.
7. Acceptable use
You agree not to misuse the Site, attempt to disrupt its operation, or submit unlawful, infringing or offensive content through custom orders, reviews or contact forms.
8. Content policy for custom orders
We do not print weapons or weapon parts, or items that infringe third-party intellectual property, or content that is obscene, hateful or unlawful. We may refuse or cancel any order breaching this policy with a refund of amounts paid for unprinted work.
9. Limitation of liability
To the maximum extent permitted by law, our liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing here limits rights you hold under applicable consumer protection law.
10. Governing law
These terms are governed by the laws of India. Disputes will be subject to the jurisdiction of the courts at our principal place of business in India.
